Abstract
The judgments issued in the second half of 1385 reveal how in Milan in the late XIV century the podestà proceeds ex officio per viam inquisitions for all crimes, with the sole exception, provided for in the statute, consisted of adultery. The podestà starts the investigation by considering the reputation (fama) and the so called clamosa insinuatio. Frequently, the elders (antiani) of the parishes intervene in the proceeding by reporting minor or major violations in fulfillment of a specific statutory duty. The accused is summoned after the podestà has drawn up an accurate titulus collecting all the factual elements and the evidence. Thereupon the trial can follow two different paths, depending on whether the accused appears in court or not: in the former case the interrogation of the accused plays a central role and it is by no means excluded that the defendant may be exonerated; in the latter, by contrast, the accused is banished and, if the violation of the judge’s order persists, he is declared in default and then convicted. It must be noted that the podestà and the giudice del maleficio (judge in criminal) strictly abide by the statutory provisions in matters of procedural documents, evidence gathering, setting deadlines for defense, and so on.
