Abstract
The etymology of the Italian word avallo ‘personal guarantee for a bill of exchange or bank check provided by a third party’ has long been a subject of debate among lexicographers and legal historians. The prevailing view traces the term to the French aval, which carries the same meaning. This study revisits the history of avallo, examining its earliest attestations, which make it possible to backdate the term by four centuries. Drawing on these occurrences and a close analysis of their meanings, the paper re-evaluates a hypothesis originally advanced by Richard Grasshoff: that avallo may ultimately derive from the Arabic word ḥawāla, a legal concept in Islamic law involving the transfer of debt. | L’etimologia della parola avallo ‘garanzia personale per un titolo cambiario o un assegno bancario offerta da terzi’ è da lungo tempo al centro di un dibattito che ha coinvolto lessicografi e storici del diritto. Al netto delle diverse ipotesi formulate, la maggior parte degli studiosi è concorde nel ricondurre il termine alla voce francese aval ‘id.’. Nel presente contributo si ripercorre la storia della parola italiana a partire da alcune attestazioni che permettono di retrodatare il vocabolo di quattro secoli. L’esame di queste occorrenze e dei rispettivi significati suggerisce di rivalutare l’ipotesi, originariamente avanzata da Richard Grasshoff, che la parola sia connessa al sostantivo arabo ḥawāla, con cui nel diritto islamico si designa il trasferimento di un debito.
